Marketing Solutions 33, LLC d/b/a Marketing Solutions (“MarketingSolutions33.xyz,” “we,” “us,” or “our”) owns and operates the website located at www.Marketingsolutions33.xyz (the “Site”). Marketing Solutions provides and maintains this Site and related messaging programs for your information, conditioned on your acceptance, without modification, of the terms, conditions and notices contained in these Terms of Service/Use (“Terms”). By accessing and using the Site or enrolling in our SMS/Text Messaging Program (“Applinks_SMS_Alerts”), you accept and agree, without limitation, to the following:

1. REGISTRATION & ELIGIBILITY

  • Registration is available only to individuals who can enter into legally binding contracts under applicable law.
  • You must be at least 18 years old and a U.S. resident to register.
  • To join as a partner in the Marketing Solutions Network, you must submit a complete application and be approved by Marketing Solutions Compliance department.
  • The Site and our services are not intended for individuals under 18.

2. MARKETING SOLUTIONS NETWORK

  • The Marketing Solutions Network allows approved Partners to promote products and services through Creative Materials supplied by Marketing Solutions.
  • Partners are solely responsible for their use of Creative Materials and compliance with applicable laws.
  • Marketing Solutions may monitor or restrict conduct but assumes no responsibility for Partner activities.
  • By using the Site, you release Marketing Solutions from claims arising from disputes with third parties, approved partners, or other users.

3. AppLink SMS Alerts

  • Applink SMS Alerts; Messages are sent by AppLinkSMSAlerts to existing customers who have opted-in to receive alerts and updates regarding their account center. Customers provide opt-in specifically when enrolling on our website. Updates from the account center include new product information and availability based on customer's preferences. Message frequency varies.
  • You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
  • If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@marketingsolutions33.xyz.
  • Carriers are not liable for delayed or undelivered messages
  • As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

4. RESTRICTIONS

You agree not to use the Site, Network, or messaging programs for illegal, fraudulent, or prohibited activities.

5. COMPLIANCE WITH LAWS

You agree to comply with all applicable federal, state, and industry regulations. Marketing Solutions may investigate suspected violations and cooperate with regulators or law enforcement.

6. INTELLECTUAL PROPERTY

All trademarks, trade names, logos, text, images, and software are the property of Marketing Solutions or its licensors. Unauthorized use is prohibited.

7. LIMITATION OF LIABILITY & DISCLAIMER OF WARRANTIES

  • The Site and messaging program are provided “as is.”
  • We make no warranties as to accuracy, reliability, or non-infringement.
  • We disclaim liability for any damages (direct, indirect, incidental, consequential, or punitive) resulting from your use of the Site, Network, or SMS program (“Applinks_SMS_Alerts”).

8. THIRD PARTY CONTENT

The Site may contain links to third-party sites. We are not responsible for those sites or their practices.

9. PRIVACY

Our Privacy Policy governs the collection, and use of your data. This includes how we handle information obtained through SMS opt-ins. By using our Site or programs, you consent to our data practices.

10. SECURITY

11. LAW AND VENUE

These Terms are governed by the laws of Utah, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Roosevelt, Utah.

VIOLATION OF THE TERMS

We may terminate your access to the Site, Network, or SMS program (“Applinks_SMS_Alerts”) if we believe you have violated these Terms, applicable law, or engaged in harmful conduct.

MISCELLANEOUS

  • Headings are for convenience only.
  • If any provision is held invalid, the remainder remains enforceable.
  • These Terms and our Privacy Policy constitute the entire agreement between you and Marketing Solutions.
